Inflection Risk Solutions · Airbnb and marketplace background checks

Removed from Airbnb over an Inflection background check?

Inflection Risk Solutions runs background checks for online platforms, and CBS News has reported that Airbnb uses it to check U.S. guests. If an Inflection report matched you to someone else's record or reported a case that should not be there, the Fair Credit Reporting Act gives you the right to dispute it and, in some cases, to sue.

Who Inflection Risk Solutions is and who relies on its reports

Inflection Risk Solutions, LLC is a background check company headquartered at 1 Montgomery Street in San Francisco. Its SafeDecision product runs automated checks from a few identifiers, such as name and date of birth, against criminal records, sex offender registries and watchlists. Inflection markets it to online marketplaces, car and ride sharing services, landlords, and home-sharing platforms. Its privacy policy says it is a subsidiary of Checkr Group, Inc. Checkr says it acquired Inflection, the parent company of GoodHire, and CBS News reported that the acquisition took place in 2022. If your report came from GoodHire or Checkr, see those guides.

Inflection is best known to consumers through Airbnb. Airbnb’s help center says it runs background checks on some users, including U.S.-based users, through an approved vendor, checking identifying information against court records and sex offender registries, but it does not name the vendor. CBS News reported in September 2023 that the vendor for U.S. and India guests was Inflection Risk Solutions. We explain Airbnb’s process, and how to appeal, in our post on Airbnb background check errors.

Why name-and-birth-date matching causes errors

A check that relies on a name and date of birth can pull in records for a different person who shares both. CBS News described one man’s 2018 online account saying Inflection would not accept changes to his report unless he gave his Social Security number, so it could rule out other people with the same name and birth date. For a person with a common name, that kind of match can lead to a canceled reservation or a removed account over a stranger’s record.

Errors that show up on Inflection reports

  • Wrong-person records. Someone else’s criminal case or registry entry attached to you because the name and birth date match.
  • Outdated outcomes. Dismissed, expunged or sealed cases still reported, or reported without the final disposition.
  • Overstated records. A charge shown as a conviction, or a misdemeanor shown as a felony.
  • Duplicates. One case reported several times.
  • Old non-conviction records. Arrests and other non-conviction records more than seven years old, which the FCRA generally bars from consumer reports.
  • Driving record mistakes. Violations or suspensions that are not yours, for platforms that order driver checks.

How to dispute Inflection Risk Solutions

  1. Find out who made the report. Look at Airbnb’s removal email, any adverse action notice, or the platform’s message. It should name the company that prepared the report and how to reach it. Use the contact details in that notice first.
  2. Request your file. The FCRA requires a consumer reporting agency to disclose the information in your file and its sources when you ask with proper identification (§ 1681g). If you were denied or removed based on the report, you are entitled to a free copy if you ask within 60 days.
  3. Send a written dispute. If your notice does not list a dispute channel, write to Inflection Risk Solutions, LLC, 1 Montgomery St., Suite 2400, San Francisco, CA 94104, the address Inflection lists on its site and in its privacy policy. Its privacy policy also lists 1-855-278-7451 as a phone number for privacy questions. Keep a copy and proof of mailing.
  4. Be specific and attach proof. Identify each wrong entry and why it is wrong. Include court dispositions, expungement or sealing orders, and anything showing the record is not yours, such as a different middle name, address history or physical description.
  5. Track the 30 days. A consumer reporting agency generally must complete its reinvestigation within 30 days of receiving your dispute (15 U.S.C. § 1681i(a)(1)).
  6. Appeal to the platform separately. Airbnb says users can appeal a removal by challenging the accuracy of the report. Send the corrected report with your appeal.

Your rights under the FCRA

  • Accuracy (§ 1681e(b)). Inflection must follow reasonable procedures to assure maximum possible accuracy of what it reports. Matching on name and birth date alone can fall short of that standard.
  • Reinvestigation (§ 1681i). It must reasonably reinvestigate disputed information and correct or delete what is inaccurate, incomplete or unverifiable.
  • Reporting time limits (§ 1681c). Arrest records and other adverse non-conviction information generally cannot be reported after seven years.
  • Adverse action notice (§ 1681m). A business that takes adverse action based on a consumer report generally must tell you, name the company that supplied the report, and explain your right to a free copy and to dispute.
  • Your file (§ 1681g). You have the right to see the information in your file and its sources.

Can you sue Inflection Risk Solutions?

Yes, when the facts support it. A lawsuit may be possible if Inflection reported a record that was not yours or was out of date without reasonable procedures (§ 1681e(b)), failed to reasonably reinvestigate your dispute (§ 1681i), or reported non-conviction records older than seven years (§ 1681c). Whether a report used by a platform such as Airbnb counts as a consumer report can depend on how it was used, which is a question a lawyer can review with you.

If Inflection negligently violated the FCRA, you may recover actual damages, such as lost bookings or income, out-of-pocket costs and emotional distress, plus attorney’s fees and costs (15 U.S.C. § 1681o). If the violation was willful, you may recover actual damages or statutory damages of $100 to $1,000, punitive damages, and fees and costs (§ 1681n). An FCRA lawsuit generally must be filed within two years after you discover the violation and within five years after it occurred (15 U.S.C. § 1681p).

What you may recover

Damages can include the cost of a canceled trip or lost lodging, lost income for hosts, and the humiliation of being labeled with someone else’s criminal record. FCRA Attorneys handles these cases on contingency. No fee unless we win.

Questions about suing Inflection Risk Solutions

Can I sue Inflection Risk Solutions?

Yes, if the facts support it. A company that sells background reports used to decide whether you can use a platform, rent a home or get a job is generally a consumer reporting agency under the FCRA. You may have a claim if Inflection reported inaccurate information without reasonable procedures, or failed to reasonably reinvestigate your dispute.

Does Inflection do Airbnb's background checks?

Airbnb's help center says it uses an approved third-party vendor but does not name it. CBS News reported in September 2023 that Airbnb uses Inflection Risk Solutions to run criminal background checks on guests in the U.S. and India. Check your removal email or any adverse action notice for the name of the company that prepared your report.

Is Inflection part of Checkr or GoodHire?

Yes. Inflection's privacy policy says Inflection Risk Solutions, LLC is a subsidiary of Checkr Group, Inc. Checkr says it acquired Inflection, the parent company of GoodHire, and CBS News reported that Checkr acquired Inflection in 2022. See our GoodHire and Checkr guides if one of those names is on your report.

If Inflection fixes the report, will Airbnb restore my account?

Not automatically. Correcting the report and appealing to Airbnb are separate steps. Airbnb says users can appeal by challenging the accuracy of a report. Send the corrected report with your appeal and keep a record of what you sent.

What does a case cost?

Nothing out of pocket. FCRA Attorneys works on contingency, with no fee unless we win, and the FCRA lets a successful consumer recover attorney's fees and costs from the company.
