Idaho has few state rules on employment and tenant background checks. There is no statewide ban-the-box law, so private employers in Idaho may ask about criminal history on a job application. Idaho does not have its own law regulating background check companies or tenant screening companies. For Idaho workers and renters, the federal Fair Credit Reporting Act is the main protection.
Under the FCRA, an employer must tell you in a stand-alone document that it will get a background report and must get your written permission. Before it rejects you based on the report, it must give you a copy and a summary of your rights so you can point out errors. Screening companies used by employers and landlords must use reasonable procedures for maximum possible accuracy. Federal law limits how long most negative items other than convictions can be reported, but convictions can be reported indefinitely.
Idaho's Clean Slate Act matters for accurate reports. Since January 1, 2024, Idaho Code 67-3004(11) has let a person ask a court to shield most nonviolent misdemeanors and certain felony drug possession convictions. A person can file five years after finishing the sentence. Once shielded, the records are unavailable to the public, and except in limited settings the case is treated as if it never occurred. Separately, section 67-3004(10) lets a person who was never charged, or whose charges were dismissed or ended in acquittal, ask for the arrest record to be expunged. A background report that still shows shielded or expunged records may be inaccurate.

Frequently asked questions
Can an Idaho employer ask about my criminal record on an application?
Yes. Idaho has no statewide ban-the-box law, so private employers may ask about criminal history at the application stage. If the employer uses a background check company, the federal FCRA still requires notice, your written permission and a chance to see the report before you are rejected.
Will a shielded record under Idaho's Clean Slate Act show up on a background check?
Shielded records are supposed to be unavailable to the public. But private background check companies sometimes keep old court data. If a shielded or expunged case appears on a report, you can dispute it, and reporting it after shielding may be inaccurate under the FCRA.
Does Idaho have special rules for tenant screening reports?
Idaho does not have a separate tenant screening statute. Tenant screening companies are consumer reporting agencies under the federal FCRA. They must use reasonable procedures for accuracy and investigate disputes, and a landlord that denies you based on a report must tell you which company supplied it.
How long do I have to file an FCRA lawsuit in Idaho?
FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
