No. Federal law does not require a lender or collector to report to any credit bureau. Many report to all three, but some report to one or two, which is one reason your Equifax, Experian, and TransUnion reports can differ. Whatever they do report must be accurate.
Reporting to credit bureaus is voluntary. The FCRA regulates how companies report, not whether they report. Its furnisher duties apply to companies that choose to furnish information.
Why reports from each bureau differ
Because each lender chooses where to report, an account can appear on one bureau’s report and not another’s. Reports can also differ because:
- Furnishers send updates on different schedules to different bureaus
- A collector may report a debt to only one bureau
- A dispute corrected at one bureau may not have been sent to the others
- Some companies, such as certain small lenders, utilities, or landlords, do not report at all, or only report when an account goes to collections
This is why it is worth checking all three reports, not just one. You can get free reports from each nationwide bureau through AnnualCreditReport.com.
What furnishers that do report must do
Once a company reports, the FCRA requires it to report accurately, correct errors, note disputes, and investigate disputes forwarded by a bureau. When a furnisher learns information it reported is inaccurate, it must notify the bureaus it reported to. When it corrects an item after a bureau dispute, it must also report the result to the other nationwide bureaus it furnished the information to.
Practical tips
- If an error shows on more than one report, dispute it with each bureau that shows it.
- If a positive account is missing from one report, the lender is not required to add it, though you can ask.
- If a negative item shows on only one report, it is not necessarily an error; check whether it is accurate.
If an inaccurate account appears on your reports and disputes have not fixed it, a free case review can help, with no fee unless we win.
