Credit Report Error Lawsuits in Oregon

Oregon has moved further than most states on medical debt. Senate Bill 605, passed in 2025 and effective January 1, 2026, amended ORS 646A.677. It bars any person from reporting the amount or existence of medical debt owed by an Oregon resident to a consumer reporting agency. It also bars credit bureaus from including in a report any item they know, or reasonably should know, is medical debt. A violation is an unlawful practice under Oregon's Unlawful Trade Practices Act, and a court may declare the medical debt void and uncollectible.

Oregon's Consumer Identity Theft Protection Act (ORS 646A.600 to 646A.628) gives residents the right to place a security freeze under ORS 646A.606. A parent or other representative may also freeze the file of a protected consumer, such as a child. ORS 646A.610 is titled "Fees not permitted," and federal law also requires free freezes at the nationwide bureaus. Other credit reporting disputes in Oregon are governed by the federal Fair Credit Reporting Act (FCRA). That law requires credit bureaus to reinvestigate disputes and requires lenders, collectors and servicers to correct information they cannot verify.

FCRA lawsuits from Oregon are filed in the U.S. District Court for the District of Oregon, which holds court in Portland, Eugene, Medford and Pendleton. A consumer may bring federal FCRA claims and, where they apply, Oregon state-law claims in the same case. The FCRA allows actual damages, statutory and punitive damages for willful violations, and attorney's fees.

Frequently asked questions

Can medical debt still appear on my Oregon credit report?

Since January 1, 2026, Oregon law bars reporting medical debt owed by Oregon residents to credit bureaus, and bars the bureaus from including it. If you see medical debt on your report, you can dispute it with the bureau and the company that reported it. A court may declare medical debt reported in violation of the law void and uncollectible.

Can I freeze my child's credit in Oregon?

Yes. ORS 646A.606 lets a parent or other representative place a freeze on a protected consumer's file, with proof of authority such as a court order, power of attorney or notarized affidavit. Freezes are free at the nationwide credit bureaus.

Where is an FCRA lawsuit filed in Oregon?

Oregon has one federal district, the District of Oregon, with courthouses in Portland, Eugene, Medford and Pendleton. FCRA cases can also be filed in Oregon state court, but they are often brought in or moved to federal court.

How long do I have to file an FCRA lawsuit in Oregon?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
