Credit Report Error Lawsuits in Portland

The Portland–Vancouver–Hillsboro metro area had about 2.5 million people in the Census Bureau's 2025 estimate, the 26th-largest in the country. It spans two states: Multnomah, Washington, Clackamas, Yamhill and Columbia counties in Oregon, and Clark and Skamania counties in Washington.

Portland renters have local rules about how credit is used. Under the city's Fair Access in Renting rules, a landlord using the low-barrier screening criteria may not reject an applicant with a credit score of 500 or more. That landlord also may not reject based on medical debt, education debt or past-due amounts under $1,000. Even so, a wrong collection or late payment can push a score down or lead to a denial for a mortgage or car loan anywhere in the metro. The Fair Credit Reporting Act requires Equifax, Experian and TransUnion to use reasonable procedures for accuracy. They must reinvestigate disputes, generally within 30 days.

Where an FCRA case is filed depends on which side of the Columbia River you live on. Oregon-side cases go to the U.S. District Court for the District of Oregon, Portland Division, in downtown Portland. Cases from Clark and Skamania counties go to the U.S. District Court for the Western District of Washington, which assigns those counties to its Tacoma courthouse.

Landlords using stricter criteria must do an individualized assessment and give written reasons for a denial. Read it

Frequently asked questions

I live in Vancouver, Washington. Is my federal case filed in Portland?

No. Clark County is in the Western District of Washington, which assigns it to the Tacoma courthouse. Oregon-side residents file in the District of Oregon in Portland. The FCRA also allows filing in state court.

Can a Portland landlord deny me because of medical debt on my credit report?

Under Portland's Fair Access in Renting rules, a landlord using the low-barrier criteria may not reject an applicant based on medical debt. A landlord using stricter criteria must do an individualized assessment and explain a denial in writing. If the medical debt itself is reported wrong, you can also dispute it with the credit bureau under the FCRA.

What happens after I dispute an error with a credit bureau?

The bureau must reinvestigate, usually within 30 days, and forward your dispute to the company that reported the item. If the information is inaccurate or cannot be verified, it must be corrected or deleted. The bureau must send you the results in writing, along with a new copy of your report if it changed.

How long do I have to file an FCRA lawsuit in Portland?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
