SambaSafety · Driving record checks and monitoring

Deactivated over a SambaSafety driving record?

SambaSafety supplies motor vehicle records and ongoing driver monitoring to employers, insurers and gig platforms, including Uber. If a SambaSafety report showed a suspended license, a violation or an accident that isn't right, the Fair Credit Reporting Act gives you the right to dispute it and, in some cases, to sue.

Who SambaSafety is and who relies on its reports

SambaSafety is a driver risk management company. It says it was established in 1998 in Albuquerque, New Mexico, and serves more than 16,000 customers, including fleets, insurers, public-sector employers and sharing-economy platforms. Its main product for consumers to know about is the motor vehicle record, or MVR, a report built from state driving records, along with ongoing license monitoring. Its Better Business Bureau profile lists an office in Greenwood Village, Colorado. The company’s compliance page refers to it as Safety Holdings Inc (d/b/a SambaSafety), and driver disputes run through the Safety Holdings website.

Uber’s help center says Uber partners with Checkr, HireRight and Samba Safety to run U.S. background checks. For a rideshare or delivery driver, that means a SambaSafety report showing a suspended license or a serious violation can end your access to the app, sometimes years after you started driving. SambaSafety says it delivers information from state DMV records and that the platform, not SambaSafety, decides who is approved or deactivated.

Why driving record errors happen

SambaSafety says the information in an MVR originates with each state’s Department of Motor Vehicles. Errors can still enter the report it sells: a record pulled for the wrong driver, a status that is out of date, a violation that was later dismissed, or a license code read the wrong way. The FCRA does not let a reporting company off the hook simply because the data came from somewhere else. It must use reasonable procedures to assure accuracy and reasonably reinvestigate when you dispute.

Errors that show up on SambaSafety reports

  • Wrong license status. A valid license reported as suspended, revoked, withdrawn or invalid.
  • Wrong-driver entries. Tickets, accidents or DUIs from another driver with a similar name or license number.
  • Stale records. Violations that were dismissed or removed, or a status that was not updated after a reinstatement or a move to another state.
  • Monitoring alerts. A flag from ongoing monitoring that leads to deactivation before you can respond.
  • Weak dispute handling. A dispute closed by referring you to the DMV without looking at the proof you sent.

How to dispute SambaSafety

  1. Request a copy of your MVR. SambaSafety says drivers can get a free copy of a report it previously prepared. Use the copy request on the Safety Holdings site, which SambaSafety lists as its page for consumer disputes and file requests.
  2. File the dispute online. Safety Holdings’ dispute instructions say to register on its Dispute Management Consumer Portal and file a new dispute. You must attach a clear photo of your driver’s license.
  3. Or dispute by mail. Download the Safety Holdings dispute form from the same page, initial and sign each indicated field, and mail it with a readable copy of your license and supporting documents to Safety Holdings, Inc., Attn: Compliance Department, PO Box 92890, Albuquerque, NM 87199-2890.
  4. Attach proof. Include a current driving record or status letter from your state DMV, court dismissal or reinstatement paperwork, and anything showing a violation belongs to someone else.
  5. Fix the state record if the state is wrong. SambaSafety says it cannot change state data. If the DMV’s own record is wrong, contact the DMV too, and keep the corrected record.
  6. Track the 30 days. Safety Holdings says it will respond within 30 days, which matches the general FCRA reinvestigation deadline (15 U.S.C. § 1681i(a)(1)). Note that its dispute process covers your most recently ordered MVR.
  7. Ask the platform for a new check. SambaSafety says only the company that ordered the report can request an updated one. Ask Uber or your employer to order a new MVR, and send it the dispute results.

How to contact SambaSafety

These are the consumer contact points SambaSafety and Safety Holdings list:

Your rights under the FCRA

  • Accuracy (§ 1681e(b)). SambaSafety must follow reasonable procedures to assure maximum possible accuracy of the driving records it reports.
  • Reinvestigation (§ 1681i). It must reasonably reinvestigate disputed information, review the documents you send, and correct or delete what is inaccurate, incomplete or unverifiable.
  • Public records for employment (§ 1681k). When it reports public-record information for employment that is likely to hurt you, it must notify you at the time or maintain strict procedures to keep that information complete and up to date.
  • Pre-adverse action notice (§ 1681b(b)(3)). Before an employer acts on a report, it generally must give you a copy and a summary of your rights.
  • Your file (§ 1681g). You have the right to see the information in your file and its sources.

Can you sue SambaSafety?

Yes, when the facts support it. SambaSafety says MVRs are governed by the FCRA and reports consumer reporting agency registrations in Maryland and Maine. A lawsuit may be possible if it reported a wrong license status or violation without reasonable procedures (§ 1681e(b)), or failed to reasonably reinvestigate your dispute (§ 1681i). Whether the employment-specific notice rules also apply to gig drivers can depend on the facts and the court.

If SambaSafety negligently violated the FCRA, you may recover actual damages, such as lost platform earnings, lost wages and emotional distress, plus attorney’s fees and costs (15 U.S.C. § 1681o). If the violation was willful, you may recover actual damages or statutory damages of $100 to $1,000, punitive damages, and fees and costs (§ 1681n). An FCRA lawsuit generally must be filed within two years after you discover the violation and within five years after it occurred (15 U.S.C. § 1681p).

What you may recover

For a driver, the biggest loss is usually the income from weeks or months off the app. Damages can also include the cost of getting DMV records and court papers, and the stress of being told you cannot legally drive when you can. FCRA Attorneys handles these cases on contingency. No fee unless we win.
