Who ADP Screening & Selection Services is and who relies on its reports
ADP Screening & Selection Services, Inc. is the background screening arm of ADP, the payroll and HR company. The CFPB’s list of consumer reporting companies describes it as a background screening company and a subsidiary of ADP, LLC, with a consumer support address in Fort Collins, Colorado. ADP’s own materials sometimes call it SASS.
Employers order these reports when you apply for a job or as a condition of keeping one. ADP says its reports can include Social Security number verification, criminal background and government registry searches, employment and education verification, credential and license checks, reference checks, credit reports, driving records, drug testing and medical screening, and international checks. ADP says its criminal search looks at county court records for felony and misdemeanor cases, including convictions and pending cases.
That range is what makes errors costly. One report can combine court records, past employers and schools, and a mistake in any of them can cost you a job offer before you know there is a problem.
Errors that show up on ADP background checks
- Wrong-person records. A criminal case of someone with the same or a similar name attached to you, even when the birth date or other identifiers don’t match.
- Cleared cases still reported. Dismissed, expunged or sealed cases that show up as if they were open or resulted in a conviction.
- Outdated records. Arrests or other non-conviction records more than seven years old.
- Wrong severity or duplicates. A misdemeanor shown as a felony, or one case listed as several.
- Wrong work history. Employment dates, job titles or reasons for leaving that a former employer or the verification process got wrong.
- Education or license errors. A real degree or license reported as unverified or not found.
How to dispute ADP Screening & Selection Services
- Get the pre-adverse action notice. Before an employer acts on a background report, it must give you a copy of the report and a summary of your rights (15 U.S.C. § 1681b(b)(3)). The notice should name ADP Screening & Selection Services.
- Request your full report. Go to adpselect.com and click Applicant Resources, which ADP’s employee support page names as the place for report questions, file disclosure requests and disputes. You can also call 888-606-7868 (option 2). ADP says it mails your report within five business days. For a report completed more than two years ago, call the Compliance Department at 800-367-5933 and press 8.
- Mark every error. For criminal records, note the case number, court, filing date and the name and birth date on the record. For work history, note the employer, dates and what is wrong.
- File the dispute. Use the dispute option under Applicant Resources, or write to ADP Screening & Selection Services, Inc., Attn: Consumer Support, 2950 East Harmony Road, Suite 130, Fort Collins, CO 80528, by a method you can track. ADP says its compliance staff will reinvestigate, notify the source of the information, and notify you of the results.
- Attach proof. Court dismissal or expungement orders, ID showing your date of birth, W-2s or pay stubs, separation letters and diplomas. Black out all but the last four digits of your Social Security number.
- Tell the employer. ADP says it notifies the employer that ordered the report when your dispute is filed and again when it is resolved. Tell the employer yourself, too, and ask it to hold the position.
- Track the 30 days. A consumer reporting agency generally must complete its reinvestigation within 30 days of receiving your dispute (§ 1681i(a)(1)).
- Keep everything. The notices, the report, your dispute and every response.

Your rights under the FCRA
- Accuracy (15 U.S.C. § 1681e(b)). ADP must follow reasonable procedures to assure maximum possible accuracy of what it reports. Matching a record to you by name alone can fall short of that standard.
- Public records for employment (§ 1681k). When it reports public records likely to hurt your job chances, ADP must either notify you at the time it reports them or maintain strict procedures to make sure the records are complete and up to date.
- Reporting time limits (§ 1681c). Arrest records and most other adverse non-conviction information generally cannot be reported after seven years. Convictions are not subject to that limit under federal law.
- Reinvestigation (§ 1681i). Disputed information must be reasonably reinvestigated, free of charge, and corrected or deleted if it is inaccurate, incomplete or cannot be verified.
- File disclosure (§ 1681g). You can see all the information in your file, its sources, and who has received it.
- Employer duties (§ 1681b(b)). The employer must get your written permission before ordering the check and give you the report and a summary of rights before taking adverse action.
Can you sue ADP Screening & Selection Services?
Yes, when the facts support a claim. The FCRA lets you sue a background check company that reports inaccurate information without reasonable procedures to assure accuracy (§ 1681e(b)), reports public records for employment without following § 1681k, reports outdated records (§ 1681c), or fails to reasonably reinvestigate after you dispute (§ 1681i). Strong cases often involve a record that plainly belongs to someone else or was cleared by a court, and a lost job or offer tied to the report.
For a negligent violation, you may recover your actual damages, such as lost wages, a lost job offer and emotional distress, plus attorney’s fees and costs (15 U.S.C. § 1681o). For a willful violation, you may recover actual damages or statutory damages of $100 to $1,000, punitive damages, and fees and costs (§ 1681n). A lawsuit generally must be filed within two years after you discover the violation and no later than five years after it occurred (§ 1681p).
