Get a copy of the report, then dispute the error directly with the screening company that produced it. That company owes you FCRA duties of accuracy and reinvestigation, generally within 30 days. Also tell the platform you have disputed it.
Rideshare and delivery platforms screen drivers through third-party background check companies. The check can include criminal records and motor vehicle records. When one of those reports is wrong, you can be denied activation or deactivated, sometimes with little explanation.
The screening company owes you duties
A company that assembles background reports on people and furnishes them to others is a consumer reporting agency under the Fair Credit Reporting Act. Its core duties apply whether you are classified as an employee or an independent contractor:
- Accuracy (§ 1681e(b)). It must follow reasonable procedures to assure maximum possible accuracy. Common problems include another person’s record, a dismissed charge shown as open, a duplicate entry, or a traffic violation reported incorrectly.
- Criminal records (§ 1681k). For employment-purpose reports, it must report the current status of public records or notify you when it reports them.
- Your file (§ 1681g). You can request everything in your file and its sources.
- Disputes (§ 1681i). It generally must reinvestigate within 30 days and correct or delete information that is inaccurate or cannot be verified.
Steps to take
- Find out which company ran the check. A notice from the platform may name it. If not, ask the platform.
- Get the report and read every entry.
- Dispute in writing with the screening company, with court records, your driving record, or identification that shows the error.
- Tell the platform you have disputed and ask it to review again once the report is corrected.
- Keep track of lost income from the date you were blocked or deactivated.
Some platforms also re-run checks or monitor records on an ongoing basis, so an error that is not fixed at the source can come back.
If a wrong background check kept you off a platform, a free case review can help you understand your options, with no fee unless we win.
