Credit Report Error Lawsuits in Hampton Roads

The Census Bureau's Virginia Beach–Chesapeake–Norfolk metro area, widely called Hampton Roads, had about 1.80 million residents in its July 2025 estimate, the 37th largest in the country. In Virginia it includes the independent cities of Virginia Beach, Chesapeake, Norfolk, Newport News, Hampton, Suffolk and Portsmouth, along with counties such as James City, York and Gloucester. It also reaches into Currituck, Camden and Gates counties in North Carolina.

Credit report errors can cost you an apartment, a car loan or a fair mortgage rate. Common problems include accounts from someone with a similar name, debts that were paid or settled but still show a balance, a collection listed twice after it was sold, and late payments reported in error. You can dispute errors with Equifax, Experian or TransUnion. The bureau generally has 30 days to reinvestigate, and the lender or collector must investigate once the bureau forwards your dispute.

If a real error is not fixed, the Fair Credit Reporting Act lets you sue. Cases from South Hampton Roads, including Virginia Beach, Chesapeake, Norfolk, Portsmouth and Suffolk, go to the Eastern District of Virginia's Norfolk Division. Cases from the Peninsula, including Newport News, Hampton and Williamsburg, go to its Newport News Division. Cases from the North Carolina counties go to the Eastern District of North Carolina, which holds court in Elizabeth City. Suits generally must be filed within two years after you discover the violation and no more than five years after it happened.

Frequently asked questions

Which federal court hears an FCRA case from Hampton or Newport News?

The Peninsula cities and counties, including Newport News, Hampton, Williamsburg, James City and York, are in the Eastern District of Virginia's Newport News Division. Virginia Beach, Norfolk, Chesapeake, Portsmouth and Suffolk are in the Norfolk Division. The FCRA also allows filing in state court.

I am an active-duty servicemember. Do I have extra credit reporting protections?

The FCRA lets active-duty military members place an active duty alert on their credit files. The alert generally lasts one year and tells lenders to take extra steps to verify identity before opening new credit. Servicemembers also have the same dispute rights as everyone else.

My report shows accounts at an old address I never lived at. Is that a sign of a problem?

It can signal a mixed file or identity theft. You can dispute the wrong addresses and accounts with each bureau. If a bureau keeps reporting accounts that are not yours after a proper dispute, you may have a claim under the FCRA.

How long do I have to file an FCRA lawsuit in Hampton Roads?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
