Credit Report Error Lawsuits in Providence

The Providence metro crosses a state line. Census estimates for 2025 put Providence County, Rhode Island at 678,179 people and Bristol County, Massachusetts at 593,640. Kent, Washington, Newport and Bristol counties in Rhode Island round out the area. People here rent and buy homes in cities such as Providence, Pawtucket, Fall River and New Bedford, and in suburbs such as Warwick and Cranston.

A credit report error can follow you to every one of those decisions. A mixed file with someone who shares your name, a paid-off car loan still showing a balance, or a collection account that was never yours can lead to a denied apartment, a higher mortgage rate or a security deposit you should not have to pay. Under the Fair Credit Reporting Act, you can dispute the error with Equifax, Experian or TransUnion. The bureau must reinvestigate, and the lender or collector that supplied the data must investigate once the bureau passes your dispute along.

If the error stays, an FCRA claim from Rhode Island can be filed in the U.S. District Court for the District of Rhode Island. The court sits at One Exchange Terrace on Kennedy Plaza in downtown Providence and covers the whole state. For people in Bristol County, Massachusetts, the federal court is the District of Massachusetts. Its Eastern Division covers Bristol County and files cases in Boston. FCRA claims can also be brought in state court.

Frequently asked questions

I live in Fall River. Is my federal case filed in Providence or Boston?

Fall River is in Bristol County, Massachusetts, which belongs to the Eastern Division of the U.S. District Court for the District of Massachusetts. Eastern Division cases are filed in Boston. Where a case can be filed may also depend on where the defendant does business, so the right court can vary.

A Rhode Island landlord turned me down because of a debt I already paid. What can I do?

You can ask the landlord for the name of the company that supplied the report and request a free copy. Then you can dispute the paid debt with that company and with the credit bureau. If the bureau or the creditor does not fix it after a proper dispute, you may have an FCRA claim.

How long do I have to bring an FCRA claim?

An FCRA claim generally must be filed within 2 years after you discover the violation, and no later than 5 years after it happened. That rule is the same in Rhode Island and Massachusetts because it comes from federal law. Keeping your dispute letters and the bureau's responses can help show when you learned of the problem.

How long do I have to file an FCRA lawsuit in Providence?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
