Credit Report Error Lawsuits in Grand Rapids

The Grand Rapids–Wyoming–Kentwood metro covers Kent, Ottawa, Montcalm, Ionia and Barry counties in West Michigan. It runs from the city of Grand Rapids and its suburbs out to Ottawa County along Lake Michigan and the smaller towns of Montcalm, Ionia and Barry counties. Across that area, renters and buyers both rely on an accurate credit report to rent an apartment, get a mortgage or finance a car.

Common credit report errors include accounts that belong to someone else, late payments that were never late, debts discharged in bankruptcy that still show a balance, and collection accounts reported twice. Identity theft can add accounts you never opened. You can dispute errors with Equifax, Experian or TransUnion. The bureau must investigate and pass your dispute to the company that supplied the information, which must investigate too.

When a bureau or furnisher does not correct a real error, the Fair Credit Reporting Act allows a lawsuit. Every county in the metro is in the Southern Division of the U.S. District Court for the Western District of Michigan, which holds court at the federal building on Michigan Street NW in downtown Grand Rapids. The FCRA also allows filing in state court. A case generally must be filed within two years of discovering the violation and no more than five years after it happened.

Frequently asked questions

Which federal court hears FCRA cases from Kent and Ottawa counties?

Kent, Ottawa, Montcalm, Ionia and Barry counties are all assigned by federal law to the Southern Division of the Western District of Michigan. Grand Rapids is one of that division's places of holding court. A case may also be filed in state court.

My bankruptcy was discharged, but my report still shows balances owed. Is that an error?

Debts discharged in bankruptcy should generally show a zero balance and be marked as discharged. You can dispute the account with each bureau that reports it wrong. If the bureau and the creditor do not correct it after a dispute, you may have an FCRA claim.

Can a Grand Rapids landlord refuse my housing voucher or other lawful income?

The Grand Rapids Human Rights Ordinance lists source of lawful income as a protected class in housing within the city. Complaints can be filed with the City's human rights office. Separately, if a landlord denies you based on a credit report, you can get a copy and dispute any errors under the FCRA.

How long do I have to file an FCRA lawsuit in Grand Rapids?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
