Credit Report Error Lawsuits in Sacramento

The Census Bureau's Sacramento–Roseville–Folsom metro area had about 2.48 million residents in its July 2025 estimate, the 27th largest in the country. It covers Sacramento, Placer, Yolo and El Dorado counties, from the capital city and West Sacramento out to Roseville, Folsom and the foothills. Whether you rent in Rancho Cordova or buy in El Dorado Hills, a credit report shapes the answer on an apartment, a mortgage rate, a car loan or a credit card.

Credit report errors can follow you for years. A loan you paid off may still show a balance. An account may belong to someone with a similar name. A debt sold to a collector may appear twice, or a late payment may be reported that never happened. You can dispute errors with Equifax, Experian or TransUnion. The bureau generally must finish its reinvestigation within 30 days, and the lender, servicer or collector that reported the item must investigate too once the bureau passes the dispute along.

If a real error is not fixed after a dispute, the Fair Credit Reporting Act lets you sue the credit bureau, the company that furnished the bad data, or both. All four counties in the metro are in the Eastern District of California, and cases from the area are heard at the federal courthouse in downtown Sacramento. An FCRA suit generally must be filed within two years after you discover the violation and no more than five years after it happened.

Frequently asked questions

Where would an FCRA case from Sacramento, Placer, Yolo or El Dorado County be filed?

All four counties are in the Eastern District of California, and the court holds court in Sacramento. The FCRA also allows a case to be filed in state court. The right court can depend on the facts and the companies involved.

My report shows a car loan I paid off as still owing. Can I dispute it?

Yes. You can dispute the balance with each bureau that reports it and send proof of payment, such as a payoff letter or title release. The bureau must reinvestigate, and the lender must review the dispute when the bureau forwards it. If the error stays after a proper dispute, you may have a claim under the FCRA.

A credit report error raised my mortgage rate. Can the FCRA help with that?

It can. If a bureau or furnisher failed to follow the FCRA's accuracy or reinvestigation rules, the law allows recovery of actual damages, which may include the extra cost of credit. Willful violations can also support statutory and punitive damages. Keeping the loan estimate and rate quotes can help show the harm.

How long do I have to file an FCRA lawsuit in Sacramento?

FCRA deadlines are the same everywhere: generally two years from when you discover the violation, and no more than five years from when it happened (15 U.S.C. § 1681p). Waiting can cost you the claim.
